These General Conditions are intended, together with the order form, and the other elements referred to therein, to regulate the terms and conditions governing the provision of the ANA QUERIDO Online Store Service by Ana Querido Unipessoal, LDA, headquartered at Estrada da Maceira, Viseu, 3510936, under the unique registration and identification number of legal person nº 271676671, hereinafter referred to as ANA QUERIDO.

Please read these terms and conditions carefully as they affect your rights and obligations under the law.

 1.1 These Terms and Conditions regulate all purchases, which include the registration, placing orders and accessing products "ANA QUERIDO".

1.2. The website www.anaquerido.com is managed by the company ANA QUERIDO, on the website www.anaquerido.com and are applicable to all product sales between ANA QUERIDO and any User that makes an order via this website.

1.3 For the purposes of these Terms and Conditions is understood by:

a) “ANA QUERIDO” – The products marketed by ANA QUERIDO through the website anaquerido.com;

b) “User” – Any individual who places an order through the anaquerido.com

1.4 The use of the website www.anaquerido.com and the purchase of products ANA QUERIDO presumes knowledge, understanding and acceptance of these Terms and Conditions by the User.

These conditions MAY be changed, as it is your responsibility to carry out YOUR periodic reading, since the conditions in force at the time of the use of the Celebration's webpage or contract (as defined below) are as applicable.

2.1 To place an order, the User can register by filling the mandatory fields of the registration form on the website www.anaquerido.com

2.1.1. You can also place your order through a simple process that does not require registration. However, when you sign up on the website your data and preferences will be recorded to be easily accessed and used in future purchases.

2.2. Upon completion of registration, the User has access to your personal account, where you can manage your account settings, your favorite items and your orders.

2.3 From the moment the User access their personal account or to this website www.anaquerido.com the User is subjected to these Terms and Conditions.

2.4. When using our website and / or placing orders through it, the customer undertakes to:

a) Use this website only to make legally valid inquiries or orders;

b) Do not place any false or fraudulent orders. If, rationally, we can consider that an order of this nature has been placed, we will have authorization to cancel it and inform the competent authorities.

c) Provide us with your email address, postal address and / or other contact details, in a true and accurate manner. You also consent to the use of the information provided to contact the customer.

If you do not provide us with all the necessary information, we will not be able to proceed with your order.

When placing an order through this website, you declare that you are over 18 and have the legal capacity to enter into contracts.

 

  1. AVAILABILITY OF THE SERVICE

The articles featured on this website are available for PREORDER. After production for up to 3 weeks, delivery to: Countries that are part of the European Union, the United Kingdom, the United States and Canada.

Portugal:  1-3 days. Working days

Rest of Zones:  1-5 days. Working days. The time may be extended if the country does not belong to the European Union or if you have to go through customs.

  1. ANA QUERIDO PRODUCTS

4.1 The website www.anaquerido.com is directed at all users who want to purchase products ANA QUERIDO, 24 hours a day, 7 days a week.

4.2 All information regarding the characteristics of the products can be found at www.anaquerido.com.

4.3 ANA QUERIDO reserves the right to modify at any time the information, the range of products, prices, promotions and the Terms and Conditions existing on the website www.anaquerido.com .

 

  1. PLACE ORDERS ON THE WEBSITE

5.1 To place an order on the website www.anaquerido.com  is necessary that the User has an email account, and that their browser is set to accept cookies and pop-ups, which will allow the full use of all the features available on ANA QUERIDO online store.

5.1.1 The User may proceed with the online purchase of products, and to do so it’s necessary to:

a) Find the product(s) you wish to purchase;

b) Add the selected product(s) to the "Shopping Cart";

c) Register the User's personal data, which includes "Delivery Address", "Billing Address", "Payment Method", telephone number and tax identification number (VAT) in case it is necessary. These data will be integrated into ANA QUERIDO database.

d) Review your order and confirm it.

5.2 The User will receive an email confirming the order with the details for the selected payment method. After we receive validation of the payment, the User will also receive an email confirmation.

5.3 ANA QUERIDO will provide all the details by email.

5.4 Your order will be delivered by the logistics operator at the delivery address provided in the purchase process.

5.5 By submitting the order form, the User agrees to these Terms and Conditions described at www.anaquerido.com .

5.6 ANA QUERIDO reserves the right to refuse and cancel orders already confirmed, in the following situations:

a) The product is not available;

b) The payment is not carried out using any of the payment methods specified on the website www.anaquerido.com;

c) The billing information is not correct or verifiable;

d) The payment cannot be confirmed;

e) There is an error in the price quotation;

f) It is not possible to deliver the order at the delivery address provided by the User.

 

  1. PLACE A PRE ORDER

6.1 The preorder is valid after payment and will be delivered during the indicated period. This does not invalidate the following points 6.3 and 6.4.

6.2 Once the pre-order is accepted, ANA QUERIDO will not be able to make any changes to it, including sizes, styles, quantities and others.

6.3 You can only cancel a pre-order if we have not started to make it.

6.4 Any delay, production change or cancellation will be communicated to the customer.

 

  1. PRICE

7.1 The prices of the products displayed on the website www.anaquerido.com include Value Added Tax (VAT).

7.2 Customs costs relating to the country of delivery of the order shall be borne by the customer.

7.3 Prices of products displayed on the website are subject to change. ANA QUERIDO reserves the right to change prices without advance notice. The prices displayed at the time of purchase are the prices applicable to that purchase.

7.4 In case there is an error in the price of the ordered products, ANA QUERIDO or the User may, up until the order is shipped, cancel the order.

7.5 The total price specified in the checkout includes the taxes from the country of origin (Portugal) and shipping costs.

7.6 The User must only pay the amount specified in the order confirmation.

 

  1. PAYMENT METHODS

8.1 The User may make payment of his purchases by the methods indicated at the time of purchase.

8.2 ANA QUERIDO does not accept any other methods of payment other than those mentioned at the time of purchase. The User should not attempt to pay by any other means that does not appear in the specified payment methods. If you do, we will not be liable for loss of payment or any other damages that may arise.

 

  1. DELIVERY COSTS

The shipping costs are supported by the client, and not ANA QUERIDO.

 

  1. DELIVERY

10.1 ANA QUERIDO shall send the product(s) ordered by the User, from Monday to Friday, from 9am to 6pm, except on holidays, and according to the days and times used by the logistics company, to the delivery address provided by the User.

10.2 Our delivery service does not include scheduling option, so delivery of the order will be made without prior contact by the carrier, being necessary to ensure that someone is at the delivery address.

10.3 The Shipping time of the products is from 10 to 15 working days.

10.4 At the time of delivery, the User must inspect the package in order to check for possible damage. If the User finds that the products are damaged, you should not accept the delivery of the order, which will be returned. The User should report the situation, if possible documented with photos, to the email info@anaquerido.com and if the User agrees, ANA QUERIDO will proceed to resend the order at no cost to the User. If the User wishes to cancel the order, the full amount paid for the order will be reimbursed.

10.5 If you do not receive your order within a maximum of 30 (thirty) working days from the order payment date, please send us an email to info@anaquerido.com informing us of what happened.

10.6 ANA QUERIDO considers the delivery done with the signature on the delivery receipt at the agreed delivery address.

 

  1. RETURNS & EXCHANGES 

11.1 The User, in the case of being a consumer, may exercise the right of withdrawal without requiring any compensation, within 14 (fourteen) days from the day on which the consumer acquires physical possession of the good.


11.2 To exercise this right, the Consumer must communicate via email to info@anaquerido.com, where he will receive the information to proceed with the return of the good purchased by the same shipping method and subject to proof within the period defined above.


11.3 The consumer must, within 7 (seven) working days from the date of communication of the resolution, return the goods to ANA QUERIDO in the proper conditions of use.


11.4 The packaging must be returned complete, as it was delivered and accompanied by the sales invoice. The package and the indicated document must be sent to the address provided later in response to the email.


11.5 Return costs will be the sole responsibility of the Consumer.


11.6 ANA QUERIDO reserves the right not to refund money. If a return is requested by the customer, ANA QUERIDO will issue a voucher with the respective value for use in future purchases in the online store. The value of the voucher will only relate to the cost of the product and not its shipping costs. The return request must be made unequivocally by sending an email to info@anaquerido.com within 14 days of receiving the order. If you have used a promotional discount code, this amount will not be refunded, that is, the refund will only be for the amount paid for the product(s).


11.7 In the absence of any of the components of the item sold or, if any of them are not in excellent condition, there will be no refund of the value, and the product will be sent back to the original shipping address.

 

11.8  ANA QUERIDO reserves the right to refuse the return of personalized products.

11.9 In the event of a return due to a defect, ANA QUERIDO assumes responsibility for collecting the item from an address specified by the customer - provided it is located in the country of origin of the purchase, and returning the value of the item by a method to be agreed with the customer. The request for a return by default must be addressed within 14 days of receipt of the order.

  1. CANCELLATIONS

12.1 Cancelling your order before shipping:

12.2 The User can cancel the order at no cost in the first 24h, provided it has not yet been shipped.

12.3 If the User places an order and wants to cancel it, they should immediately contact our Customer Service and ask for the cancellation via the email info@anaquerido.com. This procedure is essential to trigger the cancellation process. If the cancellation request is communicated in a timely manner, the User will be notified and cancellation will be processed at no cost to the User.

12.4 If the request for cancellation is not done before the products are sent, they will be shipped to the User. If the User maintains the intention to cancel the order, the User should refuse to receive it. The products will be returned and, after being received by ANA QUERIDO, in the refund to the user, any delivery costs are excluded.

12.5 By decision of ANA QUERIDO: ANA QUERIDO reserves the right not to process orders when there is any inconsistency in the personal data presented or when there is misconduct on the part of the consumer. ANA QUERIDO reserves the right not to process any order or refund in the event of errors in the values and/or characteristics of the products when these arise from technical problems or errors beyond ANA QUERIDO’s control.

 

  1. QUALITY

ANA QUERIDO does not sell second-hand products. The main characteristics of each product are shown on the website www.anaquerido.com in each product page. If you receive an item in a defective or damaged condition, or if it does not exactly match the description on our website, please contact us as soon as possible.

We will organize a return and process a full refund for the faulty item.

ANA QUERIDO will make every effort so that the colors of the products that appear on the website www.anaquerido.com are the most accurate and as real as possible. However, as computer monitors vary, we cannot guarantee that your monitor is showing the exact colors.

 

  1. COMPLAINTS

As we aim to continuously improving our services, ANA QUERIDO will strive for meeting and resolving the claims submitted by the User via the email info@anaquerido.com .

 

  1. DISCLAIMER AND LIMITATION OF LIABILITY

ANA QUERIDO does not guarantee the uninterrupted operation of the website www.anaquerido.com, or any of its functions, and may be suspended for maintenance, repair or updates.

 

ANA QUERIDO shall likewise not assume any liability for any damages, arising, directly or indirectly, from situations of major force that prevent ANA QUERIDO, in any way, from fulfilling his obligations, namely, strikes, failures electricity, telecommunication services or any other services, fires, floods, impossibility to obtain products, materials or services, malfunctions, delays of suppliers or transporters and changes in legislation or administrative regulations.

ANA QUERIDO is not responsible for any abusive use of the user's access data to the website by third parties, since they are personal and non-transferable.

 

  1. MODIFICATIONS OF THE TERMS AND CONDITIONS

ANA QUERIDO reserves the right to change, at any time, these Terms and Conditions, considering the changes made and users notified by publication on the website www.designation-official.com of the modified Terms and Conditions.

The present Terms and Conditions and all disputes arising that are related to it, including its validity, the use of the website or any purchase made on it, shall be governed by Portuguese law.
